I think (in the US) that they have to have proof of lack of payment. The ###### was actually being pretty smart in what he was doing, as he wasn't claiming that he hadn't paid, just that he wasn't going to show it to them. It looked like he had a sort of reloadable card and they wanted to scan it to see if the days fare had been taken off.
So, since they couldn't prove he hadn't paid, they had to be careful, as if they strongarmed him off and it turned out he HAD paid, they'd likely be in some trouble. Notice how things changed after he scanned his thing himself and it looked like he hadn't paid. All the sudden he wasn't interested in refusing to show proof of purchase, but was now demanding a video review to show that he had paid earlier.
It's a tricky situation, and one has to be pretty careful when dealing with "rules lawyers" like that, as you never know what sort of situation is going to happen, but you can be sure that it'll be recorded and broadcast as far as possible by the video maker. Any HINT of less than 100% amazingly stellar patience when dealing these guys will be spun out into an "abuse of authority" issue on youtube without fail.
