I have sat in many MPAA security audits over the years and was friendly with one of our senior security experts that eventually went over to the MPAA. With talking to him you basically have to have a physical copy of the copyrighted material for them to do anything. So a PC, SAN, drive somewhere with the copy on it. With streaming all they can prove is that you visited a website and data was transferred. Also, they can only charge the person that owns the device that has the physical copy. If you had a household of 10 people you can't charge them all. So in the case of something like XBMC it is not worth their while to go after the end user but the servers that hold the copyrighted material. Most of these are over seas where the laws are different but a lot of countries are slowing updating their laws to be similar to the US and Canada. I know Spain just did something this past week and a number of sites have shut down.
