Right now the driver training company gives the test so their is incentive to pass everyone regardless of performance. You fail on two accounts. One, it is already government controlled as the driver examiners have to be licensed. Passing people that should not pass could result in them losing said license, and they would be well aware of it.
Secondly, the incentive would be to FAIL the person, not pass them. By failing the person they would have to retake the test, which benefits the company.
BTW, there was a recent thread on people failing drivers tests.
