BIG difference between him a Nieuwendyk
Gilmour was angry with the Flames that entire season - he could have held out like Nieuwendyk from the start of the year (though he was in the option year of his contract), but chose to try and play through while awaiting an arbitration hearing. The hearing was held during the season, one day after the arbitrator watched a Flames game at the Saddledome with Flames management and after John Ziegler interfered with the process himself. The decision was announced in late December. Gilmour considered taking legal action against the Flames before choosing to walk out on the club.

His response was more about the corruption of the process than anything else. If something like what happened to Gilmour were to occur today, the NHLPA would be hammering the NHL over the head with anti-trust lawsuits.
