The underlying issue is the way Windows 3.1 uses sound recorder. As soon as 95 came out, they offered a proper CD player. But in 3.1 CD's were an after though, and nobody had considered using a sound card to capture audio from a CD.
All I know is it works for me.

I just hold the shift key to prevent the DRM from being started when the disk spins up, and use EAC. I haven't been stopped yet.
