I think the reduced charge was part of a plea-bargain, but not the sentence; the fact that the defense was asking for twelve years and the prosecution was asking for 17 means that there wasn't a plea-bargain in place regarding the sentence. If the sentence is part of the plea-bargain, then they present that directly to the judge.
