I'm starting to think, the only person in this thread that shouldn't lose his licence is laner.
It doesn't say in the driving handbook that you can get a ticket for not yielding to someone going over the speed limit.

I believe this is one of those laws that are of discretion. It's there so it can be enforced if someone is speeding excessively. But passing ~10 km/h over the rest of the traffic flow on a freeway is no big deal.
