Actually, no it is the other way around. Even though I am one of the poor saps that actually buys stuff on iTunes, downloading an MP3 is closer to finding a CD laying on the ground, and keeping it for personal use. And file sharing technically is not illegal in Canada. Plus you are not receiving financial gain by downloading it.
In the Walmart scenario, you have to actually commit a physical, tangible crime and are lying for financial gain. I am not a lawyer, but I suspect fraud would be where you would start. And there is a section in the criminal code so people that are caught can be prosecuted.
