Wenzel has said he will drop the suit if Nenshi apologizes which would end the law suit. The question is does this external distraction affect his ability to move forward with his agenda. This lawsuit existing allows the yop vs latte myth continue to propagate. It creates a wedge with can frame every debate. Instead apologizing and moving on would allow everything to keep moving along.
