So Ford's lawyer wants the tape released to the public (so do we all), and says Ford isn't smoking crack on the tape.

Morris also asked Blair “to indicate under oath that he’s seen the mayor smoking crack cocaine and I don’t think he could.”
“I’m saying when it’s seen publicly there won’t be a case against Mr. Ford,” Morris said.
Morris questioned the timing of Blair’s statement, hours after the release of police documents showing a connection between the mayor and Sandro Lisi, accused of extortion and drug dealing.
“It just seemed to be fortuitous…. Chief Blair just happened to be having a press conference. Very simply, they could have done this in my view, if they located a video with the appearance of the mayor smoking crack cocaine that could have been released, the public could judge what they saw – a picture is worth a thousand words — and they could have charged Mr. Lisi a week or two later,” Morris said.
Morris said that Blair’s statement — that “as a citizen of Toronto I’m disappointed” — was at odds with the chief’s “duty to report news in a dispassionate fashion…. Who appointed him judge, jury and executioner? No one. He’s been appointed in 2005 as chief of police, and with respect he should stick to that position.”

Honestly I give him 50-50 odds of walking away from this unscathed and getting re-elected. Marion Barry did get re-elected though he did not do so concurrently. Besides do any of us want him gone? There's never been a more entertaining politician in Canadian history and its not particularly close.
