By factual I meant that it is a claim about a fact, that can be proven right or wrong. I am not claiming that he is not drinking, because I do not know. However, since nobody knows what happened and it can not be proven one way or another, we and the judge will have to see whether his and her stories are consistent and make sense. If he is drinking a lot, he should have been seen in local bars. Question them. Question local beer shops. The reason why his drinking habits are important is that it seems like the only part that can be convincenly proven one way or another. As a girlfriend of a drinking man, she should have no problem naming few bars and few beer shops where he was regular. And I am not saying he is innocent I do not know yet. If she would not be able to name his fave bars and shops though - it will be clear as day that she is lying.
