It doesn't matter how the Flames interpreted it. CBA clearly states if a player played in Europe once the NHL season starts and signs with an NHL team, then he would be subject to waivers. There is even precedent of that.
That's what happened to Nabokov, Svatos, Wellwood, etc.

There's no way anyone can know what would have happened, given it was a framework CBA draft with unclear language. Those that think it was cut and dried "Flames lose their draft picks AND O'Reilly" are merely parroting the opinion of the author who wrote the original piece claiming that.
