No, The NHL would have claimed that he would have had to go through waivers, then the Flames would have said that they disagree. When the Flames' lawyers would have gotten involved, the NHL would have at the very least let the Flames revoke their contract, or at most, let the Flames do as they thought they could do.
There is ZERO chance the Flames would have given away draft picks and not gotten a player.
Remember, it wasn't just the Flames that had interpreted it wrong, other teams had interpreted it the same way. The NHL would have been forced to make good by allowing the Flames' out of the contract offer, at the very least.
It is true however, that we would not have had Monahan had we gotten O'reilly. And that itself is enough to be glad that Colorado matched, because Monahan looks like he has a higher ceiling than O'Reilly does.
