It's extremely extreme. Given the method of transmission and the fact that it's virtually impossible for HSV-1 to survive outside of the human body, his makes about as much sense as saying somebody with Crohn's shouldn't be serving food.
I guess there's the possibility that the sever scratched her cold sore with your spoon seconds before you ate your soup. But if that's the case I probably wouldn't go back there, unless the soup was really, really good.
However if a server with a cold sore is an issue for you, I'm going to strongly suggest you stop eating anywhere but your own home.
