I'll stick to my argument that it is still a unique situation, Kovalchuk still intends to play hockey.

This can't be ignored and I really think it is a mistake to ignore this.

What will the CPHL do when Kovalchuk signs with a KHL team, make him a UFA giving every team a chance to bid? That won't be fair when we all know he will play.
