I don't believe there was ever a belief that Lewis actually stabbed anyone, he was charged on the basis that his group attacked and killed the 2 men and he was active enough in the group to have that killing applied to him. Here the theory seems to be that Hernandez basically executed the guy, not that a bar fight he was in close proximity to turned into a murder. This is
a lot different than the Lewis situation.
