Well it does record audio, and unless you unplug it entirely it will be on "standby" mode, which means it really hasn't been turned off. Furthermore many users will probably forget to turn it off, and end up leaving it on most of the time, allowing it to record every day events and occurrences. So obviously at times it will record extracurricular events, whether the user intends to or not. I for one also won't be surprised if some people do find to make use of it as a recording device with the way it operates.
Sure you can
pause it, but who actually knows what Microsoft will and won't be listening to when its in standby mode.

It does bring up the notion of 1984, and unless you work for Microsoft, can you really be certain what their actual intentions of the device being on constantly is for?
And no I don't have a tin foil hat on, but with the Xbox needing to be turned on every day, so will the Kinect; and with that at least once every day Microsoft will be recording some sort of audio with the Kinect sensor. That's a major change with how the Kinect operates as of now.
