The oldest rule in lawsuits, don't sue the guy without the money and who can do the least amount of harm to you.
The Star has certainly taken the ball and run with it, and without having the video in hand to back up their claims. A reporter saying he saw the video really doesn't cut it at all. They currently can't prove the allegations visually.
If they're so sure you'd think they would have written a check the night the reporter saw it, this story would sell more then $600,000 dollars worth or paper profit, that's what smells to me. There's a real logic flaw to me in why the Star didn't snap up the video as soon as they saw it and basically have the exclusive on a huge story.
