MacInnis actually signed an RFA deal with the Blues, then the two sides negotiated the trade to cover the compensation. But yes, he was a free agent, while Nieuwendyk and Gilmour reneged on valid contracts. 20 years on, I bear no animosity toward Nieuwendyk, but I also don't think honouring him is all that important. He is the type of player that the "Forever a Flame" thing is aimed at though. They can give him an honour without sullying the retired numbers.
