You know the league would argue in favor of the owners, and therefore be on COL's side. That's another thing that pisses me off- if the NHL itself is so pro-GM and anti-offersheet, then why write it into the CBA at all? This whole thing is such a circus.
It's a slippery slope though. The point of RFAs is to limit the power they have over the teams that have their rights. If they don't have a hard deadline for when a player has to stop playing in Europe, it gives more power to the player.

The balance of power between teams and RFAs is very important to 29 other teams in the NHL. Ultimately, if the Flames had to be a casualty, it's probably something the NHL as a whole would accept and could live with (especially after Feaster just essentially killed 2nd contracts before the CBA ink was even dry).
