This was my first thought about this too. The PA would not want anything that impedes a player's ability to get the best deal possible.
I suspect there will be further clarification of the wording from the MOU, and it will ultimately come down on the side of the PA (and the side the Flames are on in this situation).
It is a pretty big risk to take, hoping you get a ruling that's in your favor on this.
