If whoever has his rights in 2 years doesn't qualify him he becomes a UFA, though that will never happen.
However, the prospect of him being guaranteed $5.5M+ for 14-15 even if he gets taken to arbitration will absolutely impact any negotiations on an extension and anyone who doesn't recognize that is being willfully ignorant. If he's not getting offers from his team that are to his liking he can basically just do nothing and he'll be guaranteed to get a high paying contract or become a UFA in 2014.
That fact is exactly why the Flames structured the contract like that. They want it to be an unpalatable contract for Colorado to match.
