The primary fault is in the system that has persisted in a state that has allowed this for so long.
You can say this person or that person is at fault for their actions, for sure, but if the system wasn't so horribly broken it never would have happened in the first place.
Everyone is at fault and everyone needs to be responsible for fixing it.
