Yeah, there aren't many people selling oversaturated shots of their lunch, so this isn't a big deal. I believe Facebook (which owns Instagram) already has something similar in their TOS, and people upload more photos there than anywhere else.

They're a free photo-sharing site trying to monetize. I'd say it's a fair trade-off.
