I would say it's not as long as you're using it for private use. Instead of lending him my original CD, I get him to burn himself a copy that I lend to him indefinitely.
So would it not be the same thing if I download something off the internet? As long as I don't pay for it or sell it to someone else, then isn't it technically the same concept? It would be like if I recorded a TV show or a song off the radio for personal use.
