I was of the impression that if the tip was on the credit card than it would be a lot harder for them to avoid claiming it.

I definitely think that they should claim their tips although I have no idea if they actually do or not. My guess would be that a lot of the servers claim some tips but not all of them.

I also agree that the customer is a jack###. I am pretty sure that his job isn't to be the morality police. I would rank him up there with the people who drive slow in the left lane and think they are doing everyone behind them a favour by preventing them from getting a ticket.
