From a practical standpoint it's probably one of those things that if you aren't bothering anyone who cares (like doing 5 over the limit, which is technically illegal) but with the ramifications of a criminal record, don't smoke out in the open, you might run into an arsehole cop having a bad day in which case you don't really have an argument in defense.
