Well I would say litigation is a result of a lesson they learned from the early 90s. They aren't letting another windows come along, template their idea, and run them out of the market. So on that front I would say they are stronger than in their dark period.

Second, Jobs was run out of Apple the first time, and replaced with someone who was inferior. This time he left with a transition plan, and the chances a person who could continue his vision is much greater.

Third, Jobs still had his fingers in this iPhone, maybe at the road map stage. However, I don't see this being the first phone Jobs would have had no hand in. These Apple products are designed over years, not months.

So overall I would say Apple is not bullet proof, Microsoft is proof of that. However, they do seem to have learned their lesson, and do stand a good shot of making it work for a while longer yet.
