I have no lawyer buddies unfortunately....at least not in Canada. Oh and apparently the guy works in a legal office, and said his partner handles this kind of stuff all day. The first part seems true (according to his voice mail at least).
I do have a witness and voicemail/phone records where he doesn't implicitly state that it was his fault, but has him talking about giving me a counter offer. I'm no lawyer, but why would you offer to pay part of something if it wasn't your fault?

The CPS won't report it to his insurer but once he comes in you can get a copy of the police report and it will have his insurer's information on it.
I would reach out to your witness and let him know of the trouble and try to get something in writing from him, just so you have it in you backpocket.
