Unless I'm mistaken, barring the middle car's driver being negligent in some way (stopped within a few inches of the car in front or perhaps not having their foot on the brakes) then it's the rear driver's responsibility.

But that is a slippery slope. I would be surprised if the laws were that vague, it'll be fairly black and white as to who is at fault, I would think.
