They have to follow the guidelines laid down in the Criminal Code and by precedent. If they impose a sentence that doesn't jive with what's been decided in the past, they run the risk of having it overturned on appeal as "demonstrably unfit".
There's a lot of inertia to overcome if the judiciary, on their own, want to start imposing harsher sentences for any kind of offence.
