It's not in any way shape or form a matter of political ideology - left, right or centre. In essence, it's a legal matter. And what happens has long term implications needing very serious consideration.

So how did Halifax manage to get this done? Are they risking a challenge or did they come to the conclusion that they have a strong enough case?

I'm no constitutional lawyer, but I can't see how the charter means you can occupy any property just because. Surely I couldn't just occupy center ice at the Saddledome based on a protest, or at least I would face legal action and fines if I did. A judge isn't going to hold up someones right to trespass, whether its called a protest or not.
