Here's some commentary from Pete Carver the chair of constitutional studies at the UofA. Those criticizing Nenshi should consider this analysis before spouting off that he's a coward or that the charter doesnt guarantee the right to camp in a public park. It's a far more complicated issue than that and I'm positive he's consulted both city in-house and external counsel in coming to his decision.

However, Peter Carver, chairman of the Centre for Constitutional Studies with the University of Alberta faculty of law, said there is a “significant possibility” the courts could rule against the city if the municipal government were to confiscate the protesters’ gear.
“I think it’s for a good reason that both the City of Calgary and other municipalities dealing with similar occupations are doing as they appear to have been doing to date,” Carver said. “And that is to be cautious in addressing these questions and to afford a significant leeway.”
