Quite the leap there, especially since you're doing the whole let's not rush to judgement thing in relation to Paterno (but are okay with it elsewhere). There could be a number of reasons why a case wasn't brought, the primary one being a need to gather evidence that would make this case a slam dunk. This is about as high profile of a case as their could possibly be, leaving the smallest opening could result in massive consequences for the DA.
