Based on the times quoted, I may not have called back right away either.

1. 8:00 he was out for dinner with the gf. By the time dinner is over, I would likely assume that the bakery was closed.

2. I would also assume that they were not open until 10:00am.

Not saying he's right in this situation, but by not requiring a deposit, the bakery assumes all risk for the cake not being picked up.

The OP also states that usually they inscribe custom messages on a piece of white chocolate placed on top of the cake. If this is true, the owner can simply replace the "name plate" and re-sell quite easily for the same $40 and is only out the $3.00 for the chocolate and the time.
