The neighbours are completly on-side with getting it removed and replaced, i'm just expecting the contractor to not come back and fix it. It's about 12" on our side of the line, and given the size of our yard this makes a big difference. I suppose the worst case scenario for me is to hire someone to remove it and possibly get stuck with the bill.
The dumb thing is is that when we built the back fence we found the survey pin and put the post right there, instead of attaching to this post they wen't out of their way to install a new post 12" on my property. really annoying!
