Posted limits are for what the government has deemed safe operating speeds for that particular road in that particular area.
What that doesn't mean is that the left hand lane is only for that speed to be followed, but should you choose to exceed that you are then open to being prosecuted for said overage.
So in fact, yes a person can technically drive whatever speed they wish but also face the consequences of such. Otherwise cars would be manufactured with a limiter built in that wouldn't allow anything over the highest posted limit in any particular country.
None of that means a lick however, when talking about what car is faster than the other car and which lane each of those cars should be in.
