Doing nothing means that the deal will fall apart soon. Issuing the bonds means that something will be done, and at least the courts can take care or it. At least then there is a slim chance that the deal can go through.

Let me know if that's not correct.
The issue is that they won't/can't issue the bonds at the current rate, a rate that has been driven up by the threat of litigation. They can't just go ahead with it based on current market conditions.
