One caveat though. It is mildly damaged.
One of the contacts in the headphone jack is loose or bent or something. When you plug in headphones the right ear works flawlessly but the left ear goes in and out. If you jiggle the cord just right the left will work but as soon as you move it will start to fade in and out.

this thread a few days ago and someone informed me about
http://www.iphix.ca/. Apparently they will repair or replace the headphone jack for $79 and they are right here in Calgary so you don't have to ship it to who knows where to get it fixed. Honestly I didn't really look into it. The repair might be an easy fix and cost you less. Maybe you can even do it yourself.
I would have gotten it fixed but I got a pretty good deal on a 4th gen touch so I'm selling this one.
If I don't get any offers I'll probably get it fixed myself and then sell it but this just seems easier.
$50. With the $79 for a replacement headphone jack that is $130 which is a pretty competitive price from what I see on kijiji.
If you can get it fixed or replaced for less than the $79 that iphix.ca charges then you could get one hell of a deal.
