I have no problem with it though. I use my phone sparingly in the car, and always with a headset. Never text in the car.

Probably not. Who's to say that the cell phone history you provide is the phone the cop saw you texting on? I think a judge or JP or whatever would take the cop's word on something like that.
I hope the cops go full on nazi about this. Nothing makes me want to get out of my car and punch another driver in the face more than that stupid head bob where they're going 10 under the limit, leaving 19 car lengths, and bobbing the head looking up, then looking down. Get the F off the road and go send your SO important message. Let the rest of us get to where we're going.
