Out of the X number of people that were there, either no one thought that it was a stupid thing to do or no one had the courage to stand up and say anything, either way it is a sad state of affairs.
At 16 you are closer to being an adult than a kid at 12 it is the other way around.

He is fully responsible and should be. However, he was drunk and horny and that is not conducive to making good choices. The other kids should have stopped them but apparently they were drunk too, as was the 12 year old girl.
What a mess.
I will say that I hope he doesn't get a harsh sentence, this situation does not seem to warrant it.
