Under the section "Liquor to intoxicated customers" it is illegal to serve to someone who is intoxicated. Servers have a duty of care to the customer.
Duty of care (in the context of liquor service)The requirement of a server or retailer to take reasonable care to avoid acts or omissions that could result in injury to a customer or innocent third-party and to take reasonable steps to protect a customer or innocent third party from foreseeable risk of injury. Frankly, it would be fairly easy for someone to prove liability; bars have people in them, liquor stores have people around, all it takes is one person to know that the person was in your establishment drinking... Driving drunk is a foreseeable risk of injury.
