There is a difference between a merge lane, and merging INTO a lane. Some intersections have the unfortunate design where you must merge into the lane that other drivers use to make a right hand turn. The yield sign means exactly that, yield to whatever happens to be in your way. Sometimes you even have to stop, although not ideal and can be dangerous.
But it is what it is, if you don't obey the yield and get lamb basted, you are at fault. These types of intersections require aggressive driving, you have to keep your head on a swivel and pay attention, and be ready to mash the gas pedal. It is sometimes far more dangerous to be slow and timid and hesitate. And for crying out loud use your signal at these types of intersections, also flashing your lights to let others know you are giving them space to merge is very very effective.
