The main point is that non-disclosure involving sex has been considered a crime. Now for non-disclosure to be a crime you would have to prove that the non-disclosure caused you harm. This is where she doesn't have a case.
So while I disagree with the man being charged I think that their would be a case to be made in some circumstance where lying to someone to get them to have sex with you could be considered a crime. What crime and what the punishment would be I am still not sure. But if cyber-bullying is becoming criminal meaning that words can cause criminal harm couldn't lying to get laid be construed as the same thing.
