If she at some point said I only bang Jewish people then the lie might be material to the sex. If he just said he was jewish or said nothing then it is likely not material

However when someone has aids even if protection is being used non-disclosure has been considered a crime and an assualt (not rape mind you). This makes sense as you are putting someone in direct physical harm.

So following the logic of that law if this person was so religious that she had mental problems after the sex then the crime might actually of occurred. However her views on pre-marital sex don't seem to fit with some one who is extremely religious. So it is a load crap

However at what point does lying become criminal. Fraud is a crime in certain circumstances. It's odd that lying to get sex has no consequence. Ie pretending you want a relationship and then just breaking up after you get some is not a crime. Yet lying about investments and running off with someone's money is a crime. In both cases people have made an investment based on trusting the information provided. And in both cases the people were subjected to loss because of lies. Its interesting that society will protect you from being conned out of money but not being conned out of sex.
