I had a related issue about a week ago. I get on the train downtown heading northeast during the afternoon and it is packed by the time we get to Centre Street Station. There was a mother with a stroller who got on, so I stand up to give my seat up, and immediately some guy who couldn't have been much older than me, if at all takes the seat I had just vacated.
Now in his defense, I don't think he had noticed the mother get on, but at the same time I was kind of pissed off about it. He was a construction worker and I assumed he had been on his feet most of the day whereas I had been sitting, so I let it pass. Still kind of irked me though.
