Let me ask you all a question.

Who here has tried pot?

Who in their lifetime has had one puff?

Now, if you believe the police don't have to properly investigate or provide the ability for a full answer and defence for the OP, then merely admitting to trying pot means without any investigation you should be charged and convicted for the criminal usage of illegal drugs.

Admitting he had a drink is not enough, according to the definition of the crime, to prove his guilt. It is required the officer take a breath sample. Just as it's required that the crown provide sufficient evidence in order to convict beyond all reasonable doubt. Frankly (if what the OP is saying is accurate) I don't think that's been done here.
