^^ Depends on exactly what you are talking about. If you are using FTA to grab the channels that are un-encrypted; that is 100% legal. However most of the time FTA is being discussed; the topic involves taking a receiver and programming it to decrypt signals that are being transmitted on a pay for use basis. (Bell, Dish Network)

And to clarify, if somebody feels the need in this thread to say "That's it- I'm going to look at FTA or a "grey market" American system; that is OK. But to talking about how you are going to go about doing it is something we don't want on here.
