You're making a pretty big assumption that the cops showed up and said 'hey, how's it going? Can we just look at your ID real quick?'. It's not at all improbable that the conversation went more along the lines of accusations and hostility, it's at least as probable as the conclusion you've come to.

BTW, Gates has said that he's happy someone called the police when they thought there might have been a break-in taking place.
