apparently not. this is the bylaw...
Every owner of a private residential swimming pool shall:
- enclose the pool within a fence not less than 1.2m in height an with openings therein not greater than 100mm in width
- permit access through the fence only by a gate or door that is equipped with a self closing mechanism, and a latch located on the pool side of the fence at a height of not less than 1.0m
